Terms of Service

1.About LIVE

LIVE Legacy (Pty) Ltd ("LIVE", "we", "us", "our") operates the LIVE platform at livelegacy.ai — a subscription service that allows individuals ("vault owners") to record personal video messages, store them securely in the cloud, and arrange for their automatic delivery to nominated recipients following the vault owner's death or verified prolonged inactivity.

These Terms of Service ("Terms") govern your access to and use of the LIVE platform. By creating an account, you agree to be bound by these Terms. Please read them carefully.

LIVE is a subsidiary of Dream Merchant Group. Our registered office is in the Republic of South Africa. These Terms are governed by South African law.

2.Eligibility

To use LIVE, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding agreements
  • Not be prohibited from using the service under any applicable law
  • Provide accurate and complete registration information

LIVE is a personal service intended for individual vault owners. You may not register on behalf of another person without their knowledge and explicit consent.

3.Your Account

You are responsible for maintaining the confidentiality of your account credentials. Do not share your password with anyone. You are responsible for all activity that occurs under your account.

If you believe your account has been compromised, notify us immediately at support@livelegacy.ai.

You may not create multiple accounts or transfer your account to another person. One subscription is for one individual's use.

4.Subscriptions and Billing

LIVE offers the following subscription tiers:

Free1 video, up to 5 minutes — no payment required
StandardUp to 10 videos, up to 30 minutes each — R189/month
PremiumUnlimited videos, up to 4K resolution — R590/month

Subscriptions are billed monthly in advance. Billing is processed by PayFast, our payment gateway. PayFast handles all payment processing — your payment contract is with LIVE Legacy (Pty) Ltd.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain full access until then. We do not offer prorated refunds for partial billing periods, except where required by applicable consumer protection law.

After your subscription ends, you have 30 days to download your content. During this 30-day window your vault remains accessible for export only — you may not record new videos or make changes. After 30 days, your vault content is permanently deleted from our servers and cannot be recovered. If you wish to continue storing your content beyond the 30-day window, you must reinstate a paid subscription before the window expires.

If your payment fails, we will notify you and allow a grace period before downgrading your account. Videos that exceed free tier limits will not be deleted — they will be locked from editing until a valid subscription is reinstated.

5.Your Content

You own all video content you upload to your vault. By uploading content to LIVE, you grant us a limited, non-exclusive licence to store, process, and transmit your content solely as necessary to provide the service — including delivering your videos to your nominated recipients at the appropriate time.

We do not claim any ownership rights over your content. We do not use your video content for advertising, AI training, or any purpose other than operating your vault.

You are solely responsible for the content you upload. You confirm that:

  • You own the content or have the right to use and share it
  • The content does not infringe the intellectual property rights of any third party
  • The content does not contain material that is unlawful, defamatory, harassing, or harmful
  • You have the consent of any other identifiable individuals featured in your videos to include them in messages intended for your recipients

We reserve the right to remove content that we reasonably believe violates these Terms, applicable law, or poses a risk of harm, though we have no obligation to actively monitor vault content.

6.The Dead Man's Switch — Acknowledgement and Limitations

The LIVE dead man's switch is an automated inactivity detection system. You agree to and understand the following:

How it works

  • When you create an account, you configure a check-in interval (3, 6, or 12 months)
  • Each time you log in and click "I'm still here", your check-in timer resets
  • If you do not check in before your interval expires, LIVE will begin an escalation sequence — reminder emails, then executor alerts
  • If inactivity continues for 30 days beyond your interval, and executor confirmation is received (or no executor exists), your vault will enter a 72-hour release hold
  • If the 72-hour hold is not cancelled, your videos will be released to recipients

The 72-hour hold and cancellation

  • When a release is scheduled, you will receive an email at your registered address with a cancellation link
  • You have 72 hours from the time the hold begins to cancel the release by clicking the link
  • If you cancel, your vault is reset and your check-in timer is restarted — no messages are sent
  • After the 72-hour window closes, the release executes and cannot be undone

Acknowledged limitations

  • LIVE's dead man's switch is not a substitute for a legal will, estate plan, or formal testamentary instrument. It is a personal communication service only.
  • LIVE cannot guarantee delivery of emails to recipients — email deliverability depends on factors outside our control (spam filters, closed email accounts, etc.)
  • LIVE cannot guarantee that a recipient's email address will remain valid for the duration of your subscription
  • In the event of false triggering (e.g., due to prolonged hospitalisation without internet access), your sole remedy is to cancel the release within the 72-hour window, or contact support at support@livelegacy.ai urgently
  • LIVE shall not be liable for emotional distress, reputational harm, or any other consequence arising from a false positive release that occurs because the 72-hour cancellation window was not used

7.Executor Responsibilities

An executor is a person you nominate to confirm your passing and trigger the release of your vault. By nominating an executor, you understand and agree that:

  • You have obtained the executor's informed consent before nominating them
  • You will keep your executor's contact details up to date
  • The executor portal link sent to your executor is sensitive — it enables them to trigger the release of your entire vault. Treat it as you would a key to your home.
  • LIVE sends the executor a welcome email with their portal link. It is the executor's responsibility to keep this link secure.
  • If your executor is no longer able or willing to act, you should update your executor nomination promptly

To executors reading this: By using the executor portal, you confirm that you are acting in good faith and that, to the best of your knowledge, the vault owner has passed away. Making a false confirmation may expose you to liability under applicable law. LIVE will not be held liable for a release triggered in good faith by an executor.

8.Recipient Designation

Recipients are individuals you designate to receive specific video messages. You confirm that:

  • You have a legitimate reason to send a personal message to each recipient
  • You have provided accurate contact details for each recipient
  • You understand that recipients will receive a welcome email informing them that a message has been stored for them

LIVE sends recipients a one-time welcome email when you add them to a video. No other contact is made with recipients until a release is triggered. We do not use recipient email addresses for marketing.

Recipient viewing links are single-purpose — they provide access only to the specific video they were sent for. No account is required. Links expire one year after delivery.

9.Acceptable Use

You may not use LIVE to:

  • Upload, store, or transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or obscene
  • Upload content that infringes any third party's intellectual property, privacy, or publicity rights
  • Impersonate any person or entity
  • Use the platform for any commercial purpose other than your own personal vault
  • Attempt to gain unauthorised access to any part of the platform, other accounts, or our infrastructure
  • Reverse engineer, decompile, or attempt to extract source code from the platform
  • Use automated tools to scrape, crawl, or probe the platform
  • Attempt to circumvent or manipulate the dead man's switch or release mechanisms

We reserve the right to suspend or terminate any account that we reasonably believe is violating these restrictions, without prior notice where necessary to protect the platform or other users.

10.Service Availability

We aim to provide a reliable, high-availability service, but we do not guarantee uninterrupted access. The platform may be unavailable due to:

  • Scheduled or emergency maintenance
  • Infrastructure failures beyond our reasonable control
  • Force majeure events

We will not be liable for any harm caused by service interruptions, provided we take reasonable steps to minimise downtime and communicate planned maintenance in advance.

The dead man\'s switch cron job runs daily. In the event of a prolonged platform outage, escalation emails may be delayed. LIVE shall not be liable for any consequence arising from delayed escalation due to infrastructure failure.

11.Limitation of Liability

To the maximum extent permitted by applicable law:

  • LIVE is provided "as is" and "as available" without warranties of any kind, express or implied
  • We do not warrant that the service will be error-free, secure, or uninterrupted
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform
  • Our total liability to you for any claim arising out of or related to these Terms shall not exceed the total amount you paid to LIVE in the 12 months preceding the claim

Nothing in these Terms limits liability for death, personal injury, or fraudulent misrepresentation caused by our negligence, or any other liability that cannot be limited by law.

South African consumer protection law (including the Consumer Protection Act 68 of 2008) may grant you rights that cannot be excluded by contract. These Terms do not affect those rights.

12.Intellectual Property

All aspects of the LIVE platform — including the software, design, trademarks, name, and documentation — are owned by LIVE Legacy (Pty) Ltd or its licensors and are protected by applicable intellectual property law.

You are granted a limited, non-exclusive, non-transferable licence to use the platform solely for its intended purpose during the term of your subscription. No other rights are granted.

13.Account Termination and Data Deletion

Cancelling your subscription does not immediately delete your account or content. Following cancellation you retain read-only access to your vault for 30 days to download your videos. After that window, all vault content is permanently deleted. See the Subscriptions section above for the full data retention policy.

You may delete your account at any time from your account settings. Account deletion is immediate and permanent — it does not wait for the 30-day download window. Deleting your account will:

  • Cancel your subscription immediately (no refund of the current billing period)
  • Permanently delete all your videos from storage — this cannot be undone
  • Remove all recipient and executor records
  • Delete your profile data, subject to legal retention requirements
  • Invalidate all outstanding executor portal tokens and recipient watch links

We may terminate or suspend your account if we have reasonable grounds to believe you have materially breached these Terms, engaged in fraudulent or unlawful activity, or pose a risk to the platform or other users. Where possible, we will notify you and give you an opportunity to respond before terminating your account.

If your account is terminated by us for breach, we are not obliged to refund any prepaid subscription fees.

14.Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

If you have a dispute with LIVE, please contact us first at legal@livelegacy.ai. We will make a genuine effort to resolve disputes informally before either party pursues formal proceedings.

If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of South Africa. If you are a consumer in the EU or UK, you retain the right to bring proceedings in your local courts.

15.Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email and by updating the effective date at the top of this page. We will give you at least 14 days' notice of material changes before they take effect.

Continued use of LIVE after the effective date of revised Terms constitutes your acceptance. If you do not agree to the revised Terms, you must stop using the platform and delete your account before the revised Terms take effect.
